This document serves as a comprehensive policy and agreement document regarding the terms of sales of “Kalm: Skin + Body Studio”. By placing an order with us you will be agreeing to the terms below. These are provided to ensure both parties are aware of and agree upon this arrangement to mutually protect and set expectations for our service.

This website is operated by “Kalm: Skin + Body Studio”. Throughout the site, the terms “we”, “us” and “our” refer to “Kalm: Skin + Body Studio”. “Kalm: Skin + Body Studio”  offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Shopify Inc. They provide us with an online e-commerce platform that allows us to sell our products and services to you.

1. Stock availability
Subject to stock availability. We try to maintain accurate stock counts on our website but from time to time there may be a stock discrepancy and we will not be able to fulfill all your items at the time of purchase. In this instance, we will fulfill the available products to you, and contact you about whether you would prefer to await restocking of the back ordered item or if you would prefer for us to process a refund.

2. Shipping Costs
Shipping costs are a standard flat rate and are added during checkout based on the order price. Orders over R500 qualify for free shipping. Payment for shipping will be collected with the purchase. This price will be the final price for shipping cost to the customer.

3. Returns
We currently only deliver within South Africa.

“Kalm: Skin + Body Studio” will happily accept returns due to change of mind as long as a request to return is received within 7 days of receipt of the item and is returned in original packaging, unused, undamaged, and in a resellable condition. Return shipping will be paid at the customer's expense and will be required to arrange their own shipping. Once returns are received and accepted, refunds will be processed to store credit for a future purchase. We will notify you once this has been completed through email. “Kalm: Skin + Body Studio” will refund the value of the goods returned but will NOT refund the value of any shipping paid.

Should a product be damaged or defective at the time of delivery or collection, please notify us right away by contacting us via our email address, info@kalm-studio.co.za. We will arrange for the damaged product to be collected at no charge, and after we have inspected the product (as well as any/all returned accessories), we will arrange to replace the product as soon as possible, or issue a credit to the value of the purchase price if no replacement is possible, or issue a refund if preferred.

The following will not be regarded as defects and will not entitle the purchaser to a credit:

  • Products that have expired will not be valid to a credit on return;
  • Faults resulting from normal wear and tear;
  • Damage arising from negligence, abuse by the user, or incorrect usage of the product;
  • Damage arising from overexposure to sunlight;
  • Damage arising from failure to adequately care for the product;
  • Damage arising from alterations made to the product;

Where the specifications of the product, while accurately described on this website, or the intended use of the product, do not suit the purchaser’s own expectations or intended use.

If a product is returned to us, for whatever reason as contemplated in the above sections, but not all products or accessories or parts of the purchase are returned, we reserve the right to refuse the return, or only to replace the item returned or to estimate the value of the missing goods and issue a credit or refund in respect only of the returned item.

Additionally, if a product is returned to us which does not comply with the above sections of this policy, “Kalm: Skin + Body Studio” shall not bear the costs of having the product collected from or returned to the purchaser.

4. Delivery terms and order processing
“Kalm: Skin + Body Studio” makes every effort to ensure timeous delivery of all orders. We also endeavor to keep our customers up to date on the status of their order(s). Should delivery timelines be affected by unforeseen circumstances that arise or circumstances that are outside of our control, we will contact you via the email address provided during checkout and provide a revised delivery schedule.

4.1 We currently only deliver within South Africa.

  • Delivery to main centers/larger cities takes approximately 1 -2 working days from the date of dispatch
  • Delivery to outlying towns/smaller cities takes approximately 2-3 working days from the date of dispatch
  • Shipping costs are a standard flat rate and are added during checkout based on the order price. Orders over R500 qualify for free shipping. Payment for shipping will be collected with the purchase. This price will be the final price for shipping cost to the customer.

4.2 Dispatch Time

  • Orders are usually dispatched within 2 business days of payment of the order.
  • Our warehouse operates Monday to Friday 08:00 – 16:00, except on public holidays at which time the warehouse will be closed. In these instances, we take steps to ensure shipment delays will be kept to a minimum.
  • Should items ordered be out of stock, we will fulfill the available products to you, and contact you about whether you would prefer to await restocking of the back ordered item or if you would prefer us to process a refund. 

4.3 Change Of Delivery Address
For a change of delivery address requests, we are able to change the address at any time before the order has been dispatched. Please communicate this to us via our email at info@kalm-studio.co.za.

4.4 Items Out Of Stock
Should items ordered be out of stock, we will fulfill the available products to you, and contact you about whether you would prefer to await restocking of the back ordered item or if you would prefer us to process a refund.

4.5 Delivery Time Exceeded
If the delivery time has exceeded the forecasted time, please contact us via info@kalm-studio.co.za so that we can conduct an investigation.

4.6 Tracking Notifications
Upon dispatch, customers will receive a tracking link from which they will be able to follow the progress of their shipment based on the latest updates made available by the courier.

4.7 Parcels Damaged In Transit
Should a product be damaged or defective at the time of delivery or collection, please notify us right away by contacting us via our email address, info@kalm-studio.co.za

4.8 Taxes
VAT has already been applied to the price of the goods as displayed on the website.

4.9 Cancellations
If you change your mind before you have received your order, we are able to accept cancellations at any time before the order has been dispatched. If an order has already been dispatched, please refer to our refund policy.

4.10 Insurance
Parcels are insured for loss and damage up to the value stated by the courier.

4.11 Process for parcel damaged in-transit
We will process credit or replacement as soon as the courier has completed their investigation into the claim.

4.12 Process for parcel lost in transit
We will process a replacement as soon as the courier has conducted an investigation and deemed the parcel lost.

6. Customer complaints
Customer complaints must follow a formal complaints process. Complaints are formally logged with “Kalm: Skin + Body Studio”. Pending an investigation outcome, the product will be credited or replaced. The customer complaint process from logging the complaint to a resolution should not take more than 5 business days.

7. Online Store Terms
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your province of residence, or that you are the age of majority in your province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time.

Credit card information is always encrypted during transfer over networks.

Prices for our products are charged in South African Rand (R) only and are subject to change without notice.

11. Products or Services (if applicable)
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

22. Gift Vouchers
Under no circumstances will Gift Vouchers purchased online or in-store be redeemed for cash or refunded. All gift vouchers have an expiration period of 36 months after purchase. Gift vouchers for “Kalm: Skin + Body Studio” can be used interchangeably with Gift Vouchers from “Kalm: Skin + Body Studio” vouchers purchased at “Kalm The Park”, “Kalm Doringkloof” and “Kalm Watermeyer Park” only.

23. Payment Options
All transactions are processed in South African Rands (ZAR). The total price of all orders includes VAT (15%) and shipping costs.

23.1 PayFast
PayFast is a South African payments processing service that enables easy, secure, and instant transfer of money between online buyers and sellers. The range of payment methods that PayFast enables on this website and a description of each is provided below:

23.2 Instant EFT
Instant EFT lets users pay using traditional internet banking with South Africa’s six main banks; ABSA, FNB, Standard Bank, Nedbank, Capitec Bank, and Investec. The electronic fund's transfer (EFT) is instantly verified (“instant EFT”). There are no waiting periods, proof of payment is not required and no financial information is disclosed to us, the merchant (website providers). Please note that you must have an active bank account with one of the six banks listed here in order to use this method.

23.3 Credit cards
Credit cards, one of the most widely used online payment methods, allow us to accept both local and international payments, using Visa and Mastercard credit cards.

24. Severability
In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

25. Termination
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
